ARKANSAS ETHICS COMMISSION SETS PROBABLE CAUSE HEARING FOR FORT SMITH DISTRICT JUDGE JIM O'HERN AND COHORTS IN ILLEGAL CAMPAIGN CONTRIBUTIONS MATTER

The Arkansas Ethics Commission has set a Probable Cause hearing for March 16th at 9:00 a.m. for Fort Smith District Judge Jim O'Hern, his campaign treasurer and two financial contributors.
The complaint involves an illegal campaign contribution O'Hern accepted during his campaign for District Judge. You can view the Citizen Complaint by clicking here.

Last week we posted about a story that was featured on Today in Fort Smith, a digital news service in Fort Smith. You can read that post by clicking here.
The story detailed shenanigans with the city of Fort Smith in which a city employee, Stephen Daw, was caught viewing pornography at work and a subsequent attempt by the city of Fort Smith to prevent the public from having detailed information about the matter.
This evening, Today in Fort Smith updated their coverage and reported that the city of Fort Smith IT Department found the remains of treasure trove of porn, from the mostly deleted and wiped hard drive from Daw's city owned laptop. You can view their post by clicking here.

Today in Fort Smith sent a Freedom of Information request to the city of Fort Smith and the prickly city administrator Carl Geffken objected to the request and sent a request for Attorney General Leslie Rutledge to back him up.

Rutledge jumped all over Geffken in her response chastising him for "lumping" all the records together and claiming that they were "employee evaluation records".
Rutledge told Geffken that his decision to withhold records was against the law.

Geffken, being put in his place and schooled on our Freedom of Information Act and had to then provide Today in Fort Smith the requested information.

CITY OF FORT SMITH INVOLVED IN MORE FOI NON-COMPLIANCE SHENANIGANS
According to a story posted online by Today in Fort Smith, an employee of the IT Department of the city of Fort Smith was caught in the act of viewing pornography on his city owned computer.
Today in Fort Smith reported that the incident occurred back in January in which an employee of the city's Information Technology Department was "sent home" as a disciplinary action after being observed viewing pornography on a city owned computer during city time.
According to sources, the incident, which possibly was captured on video as evidence and was taken by another employee, resulted in the offending employee being "sent home" for less than a day for the breach of city policy.

When the city employee was sent home that was in fact a form of suspension, thus making the details surround that particular personnel action releasable under the Arkansas Freedom of Information Act.
After some difficulty and having a terse, contentious telephone conversation with the Fort Smith City Administration Carl Geffken, a pretentious prick, we made a verbal FOI request for a document that listed the names and positions for all employees in the city's Information Technology Department and asked that it be emailed to us.

Like Today in Fort Smith, we will also be submitting a FOI request for documents regarding the incident and hope that they refuse to provide us with documents as well. We haven't been in court over a FOI denial of rights matter in a while and have some new legal arguments ready to try out.

DFA REVENUE SECURITY COORDINATOR CURTIS BRIGGS BLOCKS ACCESS TO PUBLIC MEETING - VIOLATION OF RIGHTS COMPLAINT TO FOLLOW

The publisher of this blog attempted to enter a public building today to attend an open public meeting and was denied access by DFA Revenue Security Coordinator Curtis Briggs.
Briggs illegally denied our publisher access to a public building and a public meeting due to butt-hurt over a previous post made about him on this blog in which we exposed him lying to the North Little Rock Police Officer when Briggs
deceptively indicated that he was a Little Rock Police officer killing
time trolling through Burns Park while waiting to execute a search
warrant in Lonoke.
Briggs actually worked for the Arkansas Insurance Department. And his being in the park had nothing to do with his work as an employee of the Insurance Department.
NLRPD accused him of Criminal Impersonation in a police report.
Briggs resigned, in lieu of being fired, from the Little Rock Police Department according to sources.
Briggs lied when confronted by our publisher that he had been the subject of a post on this blog.
We were not surprised that Briggs would lie. He has a lengthy history of lying as we pointed out in our previous post.
Why DFA would hire Briggs is a question that DFA will more that likely never answer. We understand he left employment with the Insurance Department unwillingly. But DFA has no problems hiring liars, after all they hired Boyce Hamlet to head ABC Enforcement.
Denial of access to a public building for a public meeting will not go well for Briggs or DFA.

PLANNED STUDENT PROTEST IN FORT SMITH MIGHT BE DERAILED BY SCHOOL DISTRICT

According to a report by Today in Fort Smith, a "March For Our Lives "event set for March 24th in support of the
nationwide demonstrations for the "March For Our Lives" movement is
being advertised as scheduled at Fort Smith Northside High School, but
such an event is seemingly in violation of a policy set forth by the
Fort Smith School Board in late July of 2015.
Today
in Fort Smith was first made aware of the proposed event when a flyer
was forwarded to them from a post on the Facebook page of a Sebastian
County Democratic organization.
As Today in Fort Smith points out,
if the event is being held on school property or utilizing school
facilities, it would seemingly be in direct violation of a policy put in
place in July of 2015 in which the school board voted 5-2 in favor of
updated requirements governing the community’s use of school facilities
That update added a “viewpoint neutral” requirement on non school-related events.

ETHICS COMMISSION ISSUES FINAL ORDER IN APRIL MATHIS COMPLAINT
The Arkansas Ethic Commission has issued the Final Order in the April Mathis Complaint.
Mathis still faces possible criminal charges in connection with her illegal activities as a Special Prosecutor has been assigned to review a criminal complaint filed by the Conway Police Department.
Mathis may have trouble rounding up funds to pay the $500.00 fine due to the Ethics Commission as according to source from a financial institution in Faulkner County, Mathis obtained a job in their loan department but failed to mention all her shenanigans and penchant for snooping in matters that did not concern her. They fired her for withholding information and being less than candid about her legal situation. You can't have someone like Mathis having access to sensitive customer information.
