STATE MEDICAL BOARD UNABLE TO ANSWER QUESTIONS ABOUT WHY THEY ALLOWED AND CONTINUE TO ALLOW DR. JAMES MERLIN HAWK TO PRACTICE IN ARKANSAS - A DOCTOR THAT THE STATE OF CALIFORNIA QUESTIONED HIS ABILTY TO PRACTICE MEDICINE DUE TO MENTAL ILLNESS

WHY DID THE ARKANSAS STATE MEDICAL BOARD ALLOW THIS DOCTOR IN THE STATE?

On April 26, 1999, the Medical Board of California found that Dr. James Merlin Hawk was so impaired by mental illness that he could only retain his license by agreeing to be on probation for 15 years and be under the supervision of a psychiatrist and undergo therapy and take medication.

To try and get out from under the "death sentence" in California, less that a year later he moved to Harrison, Arkansas and was approved to practice medicine by the Arkansas State Medical Board.

In a letter to the Medical Board of California dated May 31, 2000, Hawk surrendered his California medical license but kept his DEA certificate, a fact is important later on in this post.

Hawk lied to the Medical Board of California in his letter when he stated that Arkansas had granted him an unrestricted permanent license to practice medicine.

Arkansas granted him a license to practice on April 28, 2000 but it would expire on February 28, 2019.  Hardly a permanent license.

Why the Arkansas State Medical Board did not require Hawk to follow the same conditions that California felt were necessary for him to be able to practice medicine due to his severe mental illness is unfathomable.

Hawk ran into some trouble with the authorities over prescriptions, and he blamed employees. Folks in Harrison knew better, they believed that the employees took the fall for him.

The folks in Harrison believed that the fix was in and that Hawk was being protected - corruption in the police department and in the prosecutors office was suspected (more about that in a future post).

Hawk still had issues with prescriptions, to the point that the Arkansas Medical Board required some classes and monitoring - this added credence to the belief of Harrison residents and others that Hawk had his former employees and partners crime were supplying drug dealers with prescriptions.

It appears that it is all about the money, as Hawk agreed to pay a $3k fine to the Arkansas Medical Board and continue practicing medicine.

Hawk continued to have problems with prescriptions - no doubt the over prescribing of certain controlled substances and the Arkansas Medical Board required additional monitoring and POLYGRAPH testing.

It does not take much common sense, let alone a medical degree to know that Hawk needs to be booted out of the medical profession and not allowed to operate his sketchy drug supplying business to drug dealing individuals in the state of Arkansas.

Why the Arkansas Medical Board allowed this POS to practice in the state is a question the must be answered.

Perhaps out FOI request to for them their file on Hawk will provide some details.

Probably not.

***UPDATE 01/23/18 - 8:00PM***

We obtained a report on Hawk by Little Rock Psychiatrist Dr. Brian Hyatt. The report speaks for itself.

We question to actions of the Arkansas State Medical Board in permitting Hawk to endanger others by continuing to practice medicine in our state.

You should too.  Call them at 501-296-1802 and let them know what you think.

Here are some additional documents concerning Hawk.

This is the short recording uploaded to YouTube of Maggie Hall (Hawk’s bookkeeper), Jimmy Elliot, and Kim Hawk (Hawk's wife) in the background.  The person referred to as Joe is allegedly Joe Jester, a former Pharmaceutical sales representative.

Here's another recording.

The State Medical Board is rated among one the the worst in the county concerning transparency.

ETHICS COMMISSION FINDS THAT APRIL MATHIS VIOLATED LAW - IMPOSES $500 FINE

APRIL MATHIS ATTEMPTS TO AVOID BEING PHOTOGRAPHED

The Arkansas Ethics Commission unanimously found that April Mathis, a former employee of Cody Hiland at the 20th Judicial District Prosecuting Attorney's Office, violated Arkansas Code Annotated § 21-8-304 and imposed a $500 fine.

Our complaint to the Ethics Commission alleged that Mathis used her position to obtain sealed court records from another state, records that were of divorce proceedings of the current wife of Mathis' ex-husband.

You can read the complaint submitted to the Arkansas Ethics Commission by clicking here.

Mathis represent herself at the hearing and claimed that since she had been "sanctioned" at her former job, the matter already been dealt with and the complaint before them was moot.

Mathis also claimed that there was no policy about use of county email for personal use.

The publisher of this blog countered each defense claim made by Mathis and stated that the evidence was clear and overwhelming that Mathis used her position for personal gain and benefit.

He  pointed out that Mathis did not return the documents after she claimed she found out she was not supposed to have received them as her testimony in the hearing revealed.  Mathis tried to place blame on the circuit clerk from the other state.

The publisher also pointed out that the disciplinary action taken by her former employer had not bearing on the matter before the Commission, as did the pending investigation by Special Prosecutor Jack Quarry for possible criminal charges.

He also countered Mathis' claim about  email use and referred to an email from Faulkner County Attorney David Hogue that contained an excerpt of policy that prohibited such use.

You can read our previous posts about Mathis by clicking here, here, here, here, here and here.

We will post the Ethics Commission file as soon as it is released to us - usually it is made public 30 days after a final decision.

U.S. Senator Tom Cotton has been sending troublesome constituents and others cease and desist letters.

Hopefully Trump will appoint Cotton to some shit-hole post and appoint someone that will have thicker skin and intelligence to listen to constituents.

In the meantime let Cotton know what you think of his shit-move.

ETHICS COMMISSION SETS FINAL ADJUCATION HEARING FOR APRIL MATHIS COMPLAINT

APRIL MATHIS - CRAZY LIKE A FOX OR JUST PLAIN CRAZY?

We previously posted about April Mathis, now a former employee of Cody Hiland back when he was Prosecuting Attorney for the 20th Judicial District. You can read those posts by clicking here, here, here, here and here.

Mathis was forced to reign or be fired after her illegal activities were revealed by this blog and she filed a false police report about her children being "kidnapped."

She is now reported to be working as a substitute teacher - check you kids schools in Conway and surrounding towns - she is someone that we would not want our children or anyone's children exposed to.

We filed an complaint with the Arkansas Ethics Commission concerning Mathis using her position in the office of the Prosecuting Attorney for the 20th Judicial District for her own personal gain and benefit. You can view the complaint by clicking here.

The publisher of this blog received notice of the date for the final adjudication hearing in today's mail.

Based on our experience with the Ethics Commission, they will find that she violated Arkansas law and deal out the appropriate sanctions.

But that is not the end of April's troubles.

Conway Police also investigated Mathis and found reason to believe that she had criminally violated Arkansas laws and turned a file over to Conway City Attorney Chuck Clawson.

Clawson was reluctant to get involved as there are rumors that he and Mathis had a fling and that led to his divorce.

Clawson's divorce case was sealed and we cannot review or obtain copies of case filings to see if such allegations were made.

There must be a reason Clawson wanted his divorce case sealed as sealing divorce case files is rare, except in Faulkner County where they like to hide a lot of salacious information.

After months of prodding by the publisher of this blog, Clawson requested a Special Prosecutor be appointed.

We spoke with the appointed Special Prosecutor Jack McQuary earlier this week and he advised us that the matter is being reviewed and a decision about filing charges against her will be forthcoming.

McQuary acts as a Special Prosecutor in cases all over the state and has a busy caseload as lots of Prosecuting Attorney's don't want to get involved in a case that involves friends or individuals that they have some sort or relationship with.

We also understand from sources inside the Faulkner County Circuit Court system (yes court employees like to read this blog) that this blog was the subject of attention in a recent hearing in April's domestic relations case.

Her attorney,  James "Bugsy" Barger, wanted to find out how we obtained all our information about his client.

Too bad he did not subpoena the publisher of the blog as he would have learned about the little thing called the Arkansas Freedom of Information Act. But he is not concerned with the truth.

Stay tuned for updates.
